1. Agreement

By using smarteroutbound.com or engaging Smarter Outbound's services, you agree to these terms. Service engagements are additionally governed by the applicable order, proposal, or services agreement, which prevails over these terms where they conflict.

2. Services

Smarter Outbound provides managed outbound services, including data sourcing, infrastructure setup, messaging, multi-channel outreach, reply handling, and appointment setting. Deliverables, tiers, and pricing are described in the applicable order.

3. No guaranteed results

Outbound performance depends on market, offer, timing, and the client's sales process. We commit to the work described in the engagement — we do not guarantee a specific number of leads, meetings, or revenue outcomes, and nothing on this website should be read as such a guarantee.

4. Client responsibilities

  • Provide accurate business, offer, and service-area information.
  • Approve messaging before launch and respond to campaign approvals promptly.
  • Handle booked opportunities professionally (calls, walkthroughs, quotes).
  • Use campaign outputs lawfully, including honoring opt-outs and applicable outreach rules in your market.

5. Acceptable use

We do not run deceptive, unlawful, or abusive campaigns. We reserve the right to refuse or halt any campaign that, in our judgment, involves misleading claims, prohibited categories, or channel abuse.

6. Payment

Fees are billed monthly in advance unless otherwise agreed. See the Refund Policy for cancellation and refund terms.

7. Intellectual property

Campaign assets created for a client (copy, targeting definitions, reports) are licensed to the client for their business use upon payment. Our systems, processes, tooling, and know-how remain ours.

8. Confidentiality

Each party protects the other's non-public business information and uses it only for the engagement.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of an engagement is limited to the fees paid for the services in the preceding three months, and neither party is liable for indirect or consequential damages.
